TetherDroid User Agreement

This User Agreement ("Agreement") is a binding contract between you ("you" or "User") and TestsTrakt ("we," "us," or "TestsTrakt") governing your access to and use of the TetherDroid software, applications, desktop and mobile clients, and related services (collectively, the "Service"). By downloading, installing, pairing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not use the Service.

1. What TetherDroid Does

TetherDroid lets you connect an Android phone to your Mac or Windows computer so you can view and interact with your phone's messages, calls, contacts, notifications, and screen from your desktop. Content is relayed between your own paired devices in encrypted form. You are responsible for the devices you pair and for all activity that occurs through your account and paired devices.

2. Eligibility & Accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract.
• You are responsible for maintaining the confidentiality of your account credentials, pairing codes, and any two-factor codes, and for all activity under your account.
• You agree to provide accurate information and to keep it current.

3. License Grant

Subject to your compliance with this Agreement and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service for your own personal or internal business use. You may not sublicense, resell, or make the Service available to third parties.

4. Acceptable Use

You agree that you will only use the Service with devices and accounts you own or are authorized to control, and only in compliance with all applicable laws. You will not:

• Use the Service to access, monitor, or control any device or communications without the clear authorization of the device's owner and users;
• Intercept, record, or transmit communications in violation of any wiretapping, privacy, or data-protection law;
• Reverse engineer, decompile, or attempt to extract source code except to the extent permitted by law;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure;
• Use the Service for any unlawful, harassing, infringing, or harmful purpose.

You are solely responsible for ensuring your use of the Service — including mirroring, messaging, and call control — is lawful in your jurisdiction and authorized by every affected person.

5. Restrictions & Prohibitions

You may not use the Service to violate the rights of others, to distribute malware, to send spam, or in any manner that could damage, disable, overburden, or impair the Service. We may suspend or terminate access that we reasonably believe violates this Agreement.

6. Fees, Trials & Renewals

Certain features require a paid license. Free trials, prices, and license terms are as described in the app and portal at the time of purchase. Fees are non-refundable except where required by law. We may change pricing prospectively; changes do not affect a license already purchased for its current term.

7. Privacy & Your Content

The Service relays your messages, calls, notifications, and screen data between your paired devices in encrypted form. You retain all rights to your content. You are responsible for the legality of the content you transmit and for obtaining any consents required from other participants in your communications.

8. Third-Party Services

The Service interoperates with third-party software and platforms (for example, Google Messages, the Android operating system, and payment processors). We do not control and are not responsible for third-party services, and your use of them is governed by their own terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL BE DELIVERED, ACCURATE, OR PRESERVED. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TESTSTRAKT OR ITS OWNERS, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

11. Indemnification

You agree to defend, indemnify, and hold harmless TestsTrakt and its owners, officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of this Agreement or any applicable law or regulation; (c) your violation of the rights of any third party, including any privacy, wiretapping, or communications-consent law; or (d) any content or communications you access, transmit, record, or control through the Service. This obligation survives termination of this Agreement.

12. Suspension & Termination

We may suspend or terminate your access at any time if you breach this Agreement or if we discontinue the Service. You may stop using the Service at any time. Upon termination, the licenses granted to you end, though Sections 9–11, 13, and 14 survive.

13. Changes to the Service or this Agreement

We may modify the Service or this Agreement from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Agreement.

14. Governing Law & Disputes

This Agreement is governed by the laws of the United States and the state in which TestsTrakt is established, without regard to conflict-of-laws principles. You agree to resolve disputes on an individual basis and, to the extent permitted by law, waive any right to a jury trial or class action.
